York County Deeds, Orders, and Wills Book 13--Labor Complaints 5 August 1707 In ye. action on the Case between Cornelius Jones plt and John Loynes Deft for ye sum of fifty pounds Sterling Damages by means of the defts not procureing an Indian man named Peter Larabie to bind himself apprentice to ye sd plt for ye terme of Eight years & not paying to ye plt ye sum of four pounds sterling or the value thereof, nor delivering back to ye plt one negro woman slave according to his promise & assumption as in ye plts Declaration is contained, The Defendt having had time given him to answer ye sd action and being now called and not appearing to offer any thing in bar or preclusion of the plts action It is therefore considered by the Court that ye plt ought to recover his Damages agt the deft by means of the non performance of his promise and assumption aforesd. But because it is unknown to ye Court what damage the sd plt in that part hath sustained Therefore it is commanded that ye sherif cause to come before before her Matys Justices at the next Court to be held for this County a Jury of twelve good & Lawfull men of his Balywick by whose oaths dilligent enquiry may be made of ye sd Damages of wch the Defts attorney hath notice given him and impled ye same at the Barr Source: York County Deeds, Orders, and Wills (13) 85-86. 24 September 1707 In the accon upon the Case betwen Cornelius Jones plt and John Loynes deft. for the sum of fifty pounds Sterl Damages by means of the defts not procureing an Indian man named Peter Larabie an apprentice for the term of Eight years and not paying to the plt the sum of four pounds or the Value thereof nor delivering back to the plt a Certain negro woman slave according to his promise and assumption & as is in the decl set forth according to a rule of this Court a jury was this day sworn to Inquire of Damages whose names are John Drewry Jno: Doswell Senr: Jno: Doswell junr: Wm: Sheldon Jno. Mosse Wm Daves Jno: Walker Nicho: Phillips Jno: Aduston Rogers Simon Stacy Jno: Tomer & Wm Babb who after they had received their Charge were sent out & in some time Came again into Court and being agreed on their Verdict returned the same in these words (The jury find thirty pounds Sterl for the plt) wch: at the mocon of the plts atto: is recorded It is therefore Considered by the Court adjudged and accordingly ordered that the deft pay the sd sum of Thirty pounds sterl to the plt with Costs als Exo Source: York County Deeds, Orders, and Wills (13) 93-94.
